Although poker does not have SC approval, several Supreme Court rulings have classified poker as a game of skill. As India’s constitution says that the Supreme Court’s decision becomes the law of the land, the gaming firms argue that the Tamil Nadu state ruling is unconstitutional.
Online card games did not exist when the SC’s original decision was made, and so one might draw the disappointing conclusion that offline rummy was treated as a game of skill. Since online card games do not involve judging your opponent’s body language, you can say that they are not games of skill. Of course, these issues were raised in the US more than a decade ago, leading to similar problems.
On April 7, the Center amended its information technology rules to include gaming firms as intermediaries. These rules give gaming companies the same protection as social media companies under the Information Technology Act. Some argue that this means the Center considers online gaming legal. However, the IT Rules constitute so-called “delegated legislation” — they transfer responsibility for regulating the sector to certain bodies, in the case of self-regulatory bodies, which must be accredited by the government. They do not abrogate states’ powers to regulate gambling. .
Tamil Nadu has clarified that only online gambling is banned in its territory and the ordinance does not apply to all online gambling. Gaming companies fear the ruling could set a precedent for other states and lead to more bans.
