This disagreement stems from the popular view that online gaming and gambling are different and should be regulated by the Center and states, a point repeatedly reiterated by India’s Foreign Minister Rajeev Chandrasekhar in the past few weeks. The Indian government used the same rationale when it issued regulations in April to regulate (and legitimize) online gaming. Like the GST Council, the rules also lack a distinction between games of skill and games of chance, instead banning games related to games of chance, a move that has not been much contested by the industry.

A legal expert from Tamil Nadu pointed out that the state can challenge the rules in court as the regulation of games (be it gambling or otherwise) can fall under the state’s discretion. The decision ignores more than 60 years of settled case law and conflates online games of skill with gambling activities. This decision will destroy the entire Indian gaming industry and lead to the loss of thousands of jobs, and the only people who will benefit from this will be the National Anti-Illegal Foreign Exchange Platform. Unfortunately, when the central government has supported the industry – in terms of regulation of online gaming, clarity of TDS, etc., wrong decisions have been taken, ignoring the views of most of the GoM states who have studied it in detail. . Gaming giant Nazara said the new tax tag will not impact revenue: In a BSE filing, Nazara clarified that “this tax, once implemented, will only apply to the real money gaming segment of our business.
